Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at foodtruckcommunity.com and the related booking platform (collectively, the "Service") operated by Food Truck Community LLC ("FTC," "we," "us," or "our"), a company organized under the laws of the State of Illinois. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Nature of the Platform

FTC is a marketplace and coordination platform that connects event organizers ("Customers") with independent food truck operators ("Vendors"). FTC acts as an intermediary and facilitator — we are not a party to any contract for food truck services entered between a Customer and a Vendor. The actual food, service, staffing, and event-day performance are the sole responsibility of the Vendor.

FTC's role is limited to: (a) matching Customers with available Vendors; (b) communicating event details and logistics; (c) processing payments on behalf of Vendors through Stripe; and (d) providing coordination support before and during events. FTC does not employ or supervise Vendors and makes no warranty regarding the quality, safety, or fitness of any Vendor's food or services.

2. Eligibility and Accounts

  • You must be at least 18 years old and have the legal authority to enter into a binding agreement to use the Service.
  • If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information when creating an account or submitting a booking inquiry, and to keep that information up to date.
  • FTC reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.

3. Booking and Cancellation Policy

Booking process

A booking is confirmed only when FTC sends a written confirmation email and the applicable deposit or full payment is received. Verbal commitments, inquiry submissions, or preliminary vendor matches do not constitute a confirmed booking. FTC recommends booking at least 4–6 weeks in advance to ensure vendor availability.

Customer cancellation

  • More than 14 days before the event: Full refund of any deposit paid, minus a $50 administrative processing fee.
  • 7–14 days before the event: 50% of the total booking amount is forfeited.
  • Less than 7 days before the event: 100% of the total booking amount is forfeited.
  • Cancellations must be submitted in writing to joe@foodtruckcommunity.com. The cancellation date is the date FTC receives the written notice.

Vendor cancellation

If a confirmed Vendor cancels, FTC will make reasonable efforts to find a replacement Vendor. If no replacement is found, FTC will issue a full refund to the Customer. FTC is not responsible for Vendor cancellations but will actively work to resolve any disruption.

Weather and force majeure

Events cancelled due to extreme weather, natural disasters, government orders, or other events beyond the reasonable control of either party ("force majeure") will be handled on a case-by-case basis. FTC will work with both parties to reschedule where possible.

4. Payment Terms

  • All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service at stripe.com/legal.
  • FTC may collect a deposit at booking confirmation and the balance prior to the event, as specified in your booking proposal.
  • All prices are quoted in U.S. dollars and are exclusive of applicable sales taxes, which will be added where required by law.
  • Chargebacks or payment disputes must be directed to FTC first by emailing joe@foodtruckcommunity.com. Initiating a chargeback without first contacting FTC may result in account suspension.
  • Late payments may result in cancellation of the booking without refund of any deposit already paid.

5. Vendor Responsibilities

Vendors using the FTC platform agree to:

  • Maintain all required licenses, health permits, and insurance coverage (including commercial general liability with minimum $1,000,000 per occurrence) and provide proof upon request.
  • Arrive at the event location within the agreed setup window and remain for the full agreed duration.
  • Provide food and service that meet reasonable quality and safety standards, including proper food-handling and temperature control practices.
  • Disclose any menu changes, dietary allergen information, or service limitations to FTC and the Customer in advance.
  • Not directly solicit or accept bookings from Customers introduced through the FTC platform outside of the platform for a period of twelve (12) months from the most recent booking.
  • Comply with all applicable laws, including local health codes, parking regulations, and permit requirements applicable to their event location.

6. Customer Responsibilities

  • Provide accurate event details including date, location, estimated guest count, and any relevant access restrictions or venue requirements.
  • Ensure the event location is accessible to a full-size food truck (minimum 40 feet of clear space) unless alternate arrangements are confirmed in writing with FTC.
  • Notify FTC of any significant changes to event details as soon as possible. Changes within 48 hours of the event may not be accommodable.
  • Treat Vendors and their staff with respect. FTC reserves the right to remove Customers from the platform for abusive or harassing behavior.
  • Secure any venue-specific permits or approvals required to allow food truck operations at the event location, unless otherwise agreed in writing with FTC.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • FTC IS NOT LIABLE FOR ANY ACTS OR OMISSIONS OF VENDORS, INCLUDING BUT NOT LIMITED TO FOOD QUALITY, FOOD SAFETY, PROPERTY DAMAGE, PERSONAL INJURY, OR FAILURE TO APPEAR.
  • IN NO EVENT WILL FTC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO FTC IN THE THREE (3) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
  • FTC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF FTC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FTC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FTC MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY VENDOR INFORMATION, REVIEWS, OR AVAILABILITY DATA.

9. Intellectual Property

All content on the Service — including text, graphics, logos, images, and software — is the property of FTC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written permission. Vendors grant FTC a non-exclusive, royalty-free license to use their business name, logo, menu descriptions, and photos for the purpose of promoting the Service and their services on the platform.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service or any system or network connected to the Service.
  • Scrape, crawl, or use automated means to access or collect data from the Service without FTC's express written permission.
  • Post false, misleading, or fraudulent reviews, ratings, or information.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Circumvent, disable, or otherwise interfere with security-related features of the Service.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally will be subject to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Cook County, Illinois.

YOU AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Each party must bring claims on an individual basis. If any court of competent jurisdiction finds the class action waiver unenforceable, the arbitration provision shall not apply to that claim.

12. Changes to These Terms

FTC may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify registered users by email or by posting a prominent notice on the Service. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
